These Terms of Use are entered into by and between you and LightHome AI Ltd, company number 14281413, registered at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ (“LightHome”, “we”, “us” or “our”).
These Terms of Use, together with our Privacy Policy, set forth the terms and conditions (collectively, “Terms”) that apply to your access and use of our domain (lighthome.io) including our website: www.lighthome.io, as well as any Uniform Resource Locator (URL) or Application Programming Interface (API) by which LightHome’s data may be accessed, and our branded pages on social media services, (collectively, the “Site”). A reference to “you” or “your” is a reference to the user of this Site.
We are not a property sales or lettings agency. We are the providers of the Site. To contact us, please email general@lighthome.io.

Agreement to terms

1.1. By using or accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not want to agree to these Terms, you must not access or use the Site.
1.2. You must be at least 18 years of age to use our Site. By using our Site and accepting these Terms, you confirm that you are at least 18 years of age.
1.3. We reserve the right, in our sole discretion, to make changes or modifications to these Terms from time to time. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

Changes to our site

3.3. If you are a consumer, subject to clause 3.2, you may download material from this Site for the sole purpose of using this Site where we provide an option for you to do so. However, you must not copy, transmit, modify, republish, store (in whole or in part), frame or pass-off any material or information on or downloaded from this Site without our prior written consent.
3.4. If you are a business, subject to clause 3.2, you must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Site without our prior written consent.
3.5. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

User registration

4.1. You may be required to register with the Site. You must be at least 18 years of age to register. At our discretion, we may refuse your application for registration. If we accept your application for registration, you will be given access at the point of application.
4.2. Each registration is for a single user only. You must not share your username and password with any other person or with multiple users on a network.
4.3. You agree to keep your password confidential and accept sole responsibility for all use of and for keeping secret any password that may have been given to you or chosen by you for use on this Site You will notify us immediately of any unauthorized use of them or any other breach of security of this Site of which you become aware.

6.7.2. Use technical means to access this Site which enables, causes or facilitates you or others to access this Site in a manner prohibited by clause 6.7.1.
6.7.3. Where consent is given pursuant to this clause, we reserve the right to withdraw such permission without notice and without giving a reason.
6.9. By using the Site, you also agree not to:

6.9.2. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.

If we (in our reasonable opinion and at our sole discretion) suspect a form has been misused, irrespective of whether the misuse is a result of recklessness or negligence as to the proper use of the form or these Terms of Use, or malicious intent, we reserve the right to withhold the transmission of that form to the intended recipient(s) without notice to you.
7.2. 7.4.6. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
7.4.7. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
7.4.8. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people.
7.4.9. Your Contributions do not violate any applicable law, regulation, or rule.
7.4.10. Your Contributions do not violate the privacy or publicity rights of any third party.
7.4.11. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.
7.4.12. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
7.4.13. Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.
7.5. Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.
7.6. Where we believe a breach of clause 6 has occurred we may take such action as we deem appropriate. This action may include the following:
7.6.1. immediate, temporary or permanent withdrawal of your right to use our Site;
7.6.2. immediate, temporary or permanent removal of any posting or material uploaded by you to our Site;
7.6.3. further legal action against you; and
7.6.4. disclosure of such information to law enforcement or authorities as we reasonably feel necessary.

If you are our member, you may only link to pages about you or the summary listings page which outlines all the property listings you have uploaded to the Site provided that you do so in a way that does not (in our reasonable opinion and at our sole discretion) damage our reputation or expose us to risk.
12.4. You must not include links to this Site in any other website, application or computer program without our prior written consent. In particular (but without limiting the foregoing) you must not include in any other website any “deep link” to any page on this Site.
12.5. We reserve the right to withdraw any linking permission granted within this section, irrespective of whether prior written consent was required, without notice and without giving a reason.

We do not accept any liability for any subsequent communications that you receive directly from that member.
13.7. If you are a consumer user:
13.7.1. please note that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
13.7.1. if defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.
13.8. If you are a business user, subject to clause 13.1:

Governing law

14.2. If you are a business, these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Miscellaneous

15.1. These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us.
15.2. You may not assign or delegate any or all of your rights or obligations in these Terms of Use.
15.3. We may assign this Agreement at any time without notice to you.

15.7. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
